Total Photography Package Price Agreed * Stories in Focus Photography Wedding Photography Contract Terms This agreement contains the entire understanding between Stories in Focus Photography and the client. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing and must be signed by all parties involved. If the parties wish to waive one provision of this agreement that does not mean that any other provision is also waived. The party against whom a waiver is sought to be effective must have signed a waiver in writing. If there are any disputes or actions resulting in legal proceedings related to this contract, such actions shall take place in and be subject to the laws of England & Wales. Clients accept sole financial responsibility for any legal fees or related costs incurred by the Photographer in enforcing the terms of this wedding photography contract. Any failure by one or both parties to uphold or enforce a provision of this contract shall not constitute a waiver of any other provision of this contract. BOOKING AND PAYMENTS: A non refundable booking fee of 20% is charged when the customer “signs” with a tick below. This fee is deducted from the total coverage price. Clients acknowledge that no reservation can be made prior to the signature of this contract and subsequent payment of the service fee. The balance of the coverage fee is due 60 days prior to the Wedding day. Payments for additional photography services are to be made when these are ordered at a later date. If the final balance is not paid before 14 days of the wedding, a booking cancellation email is issued. In the event that payment is not made in full by this deadline, Photographer reserves the right to terminate this contract, retain the initial deposit, and no longer be held liable for providing further services to the Clients. RESCHEDULE: The Client may reschedule the dates of the ceremony and reception within 60 days of the Wedding date, but the Client must send a written notice via email or certified mail. Should the Photographer be unable to accommodate the Client’s rescheduled date, or is unable to find a suitable replacement Photographer, the Clients will not be held responsible for the remaining balance of this wedding photography contract, but will forfeit their initial booking fee. Where possible the Photographer will organise an alternative Photographer, if unavailable. CANCELLATIONS: The booking fee is non-refundable if the client cancels the wedding at any time. Cancellations of any wedding are subject to the cancellation rates below. Cancellation of any wedding less than 60 days of the Wedding date will result in the Client being liable to pay a percentage of the coverage fee booked. The said sum is payable as compensation of lost bookings and other losses Stories in Focus Photography may suffer. If the client should request a date change, they must do so at least 60 days before the initially scheduled event, or the below cancellation rates apply. Date transfers with concurrent booking fee transfers are limited to one occurrence. Pricing of the original event does not apply to the new date; current rates will apply. If Stories in Focus Photography is not available for the new event date, the above cancellation guidelines will follow. Clients must send a written cancellation notice via either email or certified mail. CANCELLATION RATES: More than 60 days before the wedding date: 100% is refunded of the balance payment. More than 45 days before the wedding date: 80% is refunded of the balance payment. More than 30 days before the wedding date: 50% is refunded of the balance payment. Under 30 days before the wedding date: no refund of the balance payment is offered. LIMIT OF LIABILITY: In the unlikely event that the photographer is injured or is unable to photograph the event for any reason, including acts of God, fires, illness, or extreme weather, Stories in Focus Photography reserves the right to seek to find an acceptable replacement photographer to undertake the Contract. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments, including deposit, received for the event coverage. Stories in Focus Photography takes the utmost care with respect to exposure, transportation and the processing of your photographs. However, in the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond Stories in Focus Photography’s control, Stories in Focus Photography’s liability is limited to the return of all payments received for the event coverage. Stories in Focus Photography may be limited by the guidelines of the ceremony official or the site management. Client agrees the technical results of their imposition on the photographer. Negotiation with the officials for the moderation of guidelines is the client’s responsibility; Stories in Focus Photography will offer technical recommendations only. DELIVERY: Image files will be provided via an online gallery with download feature. By releasing the high resolution images, Stories in Focus Photography authorises the Client to use the images provided for private and personal use only, this includes use of images on social media. The images MUST NOT be sold, distributed or published without prior written consent of Stories in Focus Photography. Stories in Focus Photography will retain the exclusive copyright ownership of the images as well as the exclusive rights detailed in the Copyright section of this agreement. Upon releasing the high-resolution images to the Client, Stories in Focus Photography is released of all liability for future archiving of the files. The Clients acknowledge that the Photographer does not maintain archives of images and footage after delivering requested images and other goods to the Clients. It is the Client’s sole responsibility to request any desired prints, products, or files within 90 days from the delivery. If the Clients wish to store their images for a longer period, there is an annual charge of £50 payable in advance of each years storage. VIEWING GALLERY: Online viewing gallery will be available for you and your guests to view your wedding photographs and to purchase prints and other wedding products. The viewing gallery will be available for 90 days from the release day. COPYRIGHT: Under the 1988 Copyright Designs and Patent Act, the copyrights of all photographs belong to the Photographer and the company (Stories in Focus Photography). The photographs may not be reproduced in any manner without Stories in Focus Photography’s written consent. Written consent for reproduction and display rights will be signed and sent to the appropriate person. Stories in Focus Photography owns all copyrights for any and all images produced in connection with this agreement, including the right to reproduce or publicly display such images. MODEL RELEASE: This wedding photography contract serves as a model release. This grants the Photographer the right to use all images and footage without restriction for advertising, portfolios, and other lawful purposes. The Clients waive the right to inspect any images produced using the images or footage from the events in this contract, and the right to restrict the use of the images or footage from the listed events by the Photographer. SHOOTING TIME/ADDITIONS: The photography schedule and selected methodology are designed to accomplish the goals and wishes of the client in a manner acceptable by all parties. Photographer(s) hot meals are appreciated but are not mandatory. Additional hours of Photography will be charged in addition to the agreed schedule. Payment for additional services will need to be paid before image release. TRAVEL: All travel fees are included within England and Wales. If both parties deem air travel more advantageous than road travel, the client will be responsible for direct expenses related to travel. This includes hotels, airfare, car hire, food, any applicable airport taxes and fees, parking fees and additional baggage charges. COOPERATION: Stories in Focus Photography highly recommends that the clients provide a time line of the day to highlight details of special moments during the day. Stories in Focus Photography also recommends that the client designate someone to point out important individuals to the photographer for candid and group photographs. The photographer cannot be held accountable for not photographing desired people if there is no one to assist in identifying people or gathering people for photographs. Stories in Focus Photography is not responsible if key individuals fail to appear or cooperate during photography sessions. HARASSMENT: The Clients acknowledge that they are responsible for ensuring appropriate behaviour by their guests, wedding party, and other vendors. In the event that the Photographer identifies any inappropriate, threatening, hostile, or otherwise offensive behaviour directed at them, their assistants, or their equipment, Photographer reserves the right to end coverage of the events, retain all fees paid by the Client, and hold no further responsibilities to the Clients. Photographer agrees to notify the Clients of any of the above listed behaviours, and give them an opportunity to correct such behaviours, or remove the offending individuals from the venue prior to ending event coverage. ARTISTIC LICENCE: Stories in Focus Photography is to be granted artistic licence with respect to the poses, backgrounds and locations used. All reasonable effort will be made to satisfy the wishes of the client after discussions with them to accommodate all the photographic shots required. However, in instances where bad weather, non participation of guests or Bride and Groom or associated parties or any other circumstance at the event, the best judgement of Stories in Focus Photography shall be made. If for any reason, Stories in Focus Photography experiences a lack of co-operation from the Bride and Groom or associated parties and photographs are unable to be taken to Stories in Focus Photography’s instructions, Stories in Focus Photography cannot be held liable. The photographs will provide a pleasing colour balance, but we cannot guarantee exact colour matching. Please view our gallery and website to see our editing style. We cannot guarantee the use of overhead drone photography, where location, whether or technical issues are limiting us from using the drone, we will not add this to our package. ON THE DAY: a) Stories in Focus Photography is the only authorised photographer for the day. Other professional photographers are not permitted whether official or otherwise, working for pay or otherwise (e.g. separately employed by parents, other suppliers, contracted by magazines or newspapers), unless agreed in writing before the day. Breach of this condition shall be deemed cancellation of the contract by the clients.b) An inconsiderate guest can wreck the documentation of your special day and we will speak with the guest or bride or groom or coordinator if appropriate. Coverage may be canceled without warning at the discretion of Stories in Focus Photography if the photographer feels threatened or has reason to believe that equipment may be damaged.c) Stories in Focus Photography and the client agree to cooperate and communicate with each other to achieve the best possible results within the understanding of this contract. The client also agree to give Stories in Focus Photography sufficient warning of key events such as, but not limited to bouquet throwing, first dance to give the photographer time to prepare.d) Most of your guests will have a digital camera of some variety. In the spirit of cheerful cooperation, the client(s) agrees to give Stories in Focus Photography precedence over the guests in order for us to be able to capture the photographs/footage required. Stories in Focus Photography will not be held responsible for a guest stepping in front of the camera and ruining a key moment.e) For a booking involving a church ceremony or at certain venues, the photographer(s) movements are sometimes restricted by the official in charge. The area from which thephotographer(s) is able to cover the ceremony may not be the photographer(s) choice and Stories in Focus Photography cannot accept responsibility for any obstructed view should this be the case. The use of artificial lighting may be restricted or prohibited. The photographing of parts or even all of the ceremony may be restricted or prohibited. Client(s) are strongly advised to check with the appropriate official before signing this contract or selecting a venue. f) For a wedding or other event booking, Stories in Focus Photography shall endeavor to capture all the moments throughout the day as they occur. However, because of the fluid and live nature of the event, some moments might not be recorded, or not recorded for logistical reasons. PRE-WEDDING CONSULTATION: The parties agree to a pre-wedding consultation 6-8 weeks prior to the event date in order to finalise the times and locations where the photographic services will take place. All client requests will also be discussed. I/we understand that the terms of this agreement cannot be changed unless agreed by Stories in Focus Photography in writing. I realise that this contract becomes effective immediately and agree my booking fee of 20% is not refundable and cancellation rates will apply in the case of any cancellation. A copy of this contract will be posted out to you after booking.
